‘This advice will inform negotiations (where required) with various developers and TfL to reallocate S.106 contributions to the Aldgate project. Work will now begin to establish a strategy for approaching developers to discuss reallocation of funds. These

negotiations will begin in early 2015. If reallocation is agreed by developers and TfL, in some cases (depending on the terms of each S.106 agreement) the reallocation will be subject to a deed of variation to vary the terms of the original S.106 agreement.

Where this step is necessary Comptroller and City Solicitors will negotiate and complete deeds with developers through their solicitors.’

Petticoat Tower Replacement of Windows and Balcony Doors

  1. At the time of the meeting on 26 September, it had been intended that the cost of replacing the balcony doors and windows to leaseholder properties would be met from the remainder of the S106 funding from the Minerva Tower development. Unfortunately, we were subsequently advised that the S106 contributions for the double-glazing works were time limited to the fifth anniversary after the completion of the Minerva Tower development and, because the fifth anniversary had been and gone, the contributions were subsequently put to another use and applied to the Aldgate Square Project.

Could this Wardmote ask the City of London to explain how they were able to reach agreement with various lawyers to change the hypothecation, by deed of covenant, in Favour of the Aldgate Project, but found themselves unable to do the same to prevent the time limitation of Petticoat Tower Windows and Balcony Doors.

The Councillors must provide answers... It is CLEAR that business comes first, residents are ignored time and time again.
